Good morning everyone. I hope you are all well. I have been struggling to get on here for some time now because of my working hours and just when things were about to get better, its got worse. Well I have been working long hours and stuck on night shifts. My boss promised me a change to days back in July and changed the rota accordingly however, recently my boss has asked me to lie to the police about why we detained two young lads and I found out that my boss does not have a CCTV licence. My boss has also employed non licenced guards and deployed them into the control room. The issue with this is that it is a criminal offence to undertake licensable activity without a licence. It also means if when I am on shift and I let someone into control to use the CCTV to give me a break from the screens, go to the toilet etc then I would be in breach of the law and subject to fines, loss of licence and possibly more in the event we are spot checked by the SIA or someone reports it. I have decided that I cannot break the law and have raised a complaint against my boss. I am due a telephone meeting with the area manager on Friday morning at 8am UK time to discuss my complaint. In the meantime my boss has been allowed to carry on running the site and my hours have been stripped back by my boss as soon as he found out I made the complaint against him. My next shift is the 4th November as it currently stands. I have recieved advice from an employment solicitor in advance of my meeting via the phone and they advised I am legally allowed to have someone be a witness during this meeting incase the company try and cover this complaint up. I have been told if I don't like it then I can leave. I am on a zero hour contract yet up until my boss finding out about my complaint I have been doing full time hours without issue. The solicitor has advised me that I am protected under whistle blowing laws and they cannot reduce my hours as a result of my complaint. This means that the company cannot hide behind zero hours contracts. A zero hour contract means that I can refuse shifts and the company can decide not to offer me any shifts under normal circumstances. My boss has told me that if I drop my complaint against him then he will drop a counter complaint against me. Not only is this intimidation, it is strange because I am told I am one of the best guards on site and the centre manager does not want to loose me. This is just the tip of the iceberg of my complaint. It actually ran into 4 pages with over 3000 words. To give you an idea of the setup here - Centre is owned by one company who employ a management company to run the centre. The management company then employes the security and cleaning companies to provide those respective services. Please pray for my upcoming meeting. It feels like although I am the one making the complaint, I am the one being penalised.
Many thanks and may God bless you all.
BLESS YOUR HEART DAN. YOU WERE RIGHT TO FILE A COMPLAINT, MORE IMPORTANTLY TO PROTECT YOURSELF SINCE YOU DO HAVE ALL YOUR CREDS AND THIS MANAGER IS BASICALLY RIDING YOUR CREDS AND CLEARANCE WITHOUT HAVING TO COMPLETE AND HAVE HIS OWN. AND YES WHAT YOUR BOSS HAS DONE IS AGAINST THE LAW. I AM PROUD OF YOU FOR STANDING. REMEMBER OUR JESUS IS WITH YOU. BUT TAKE ADVICE FROM SOMEONE WHO HAS WORKED WITH ATTORNEYS AND THE COURTS. MAKE SURE YOU TAKE YOUR SOLICITOR WITH YOU. THEN IT WILL NOT BE A HE SAID OR SHE SAID THING. AND YOU NEED YOUR SOLICITOR THERE TO PROTECT YOUR RIGHTS AND TO MAKE SURE THAT MANAGEMENT KNOWS YOU ARE REPRESENTED! I AM PRAYING FOR YOU!!
Thank you all
My phone meeting is on Wednesday morning now at 8am but on Tuesday I will be calling the Directors line going way above the area manager to see what sort of response I get. In the meantime my hours have been stripped out and the boss is free to carry on. They are using zero hours contract as justification for cutting my hours but by law they cannot do this as my hours were only cut once my complaint went in and I am protected via whistle blowing laws so that is something going in my favour. Tomorrow I am off to get a printer and then print all my evidence out in preparation for Wednesday. All this is tiring me out despite the fact I have not worked for just over a week. I am thankful for Jesus and my God given family and in Jesus I go forward.
God bless you all and I will keep you posted on any updates to this situation.
